« 9.3.9. Any new tenants who wish to rent the condo must
obligatorily retain the services of a company offering a
pre-rental investigation service (such as ProprioEnquête or
Oligny-thibodeau) in order to obtain a complete portrait of
the candidate-tenant prior to the conclusion of the lease,
which must include, at a minimum, his credit report, his
court record and his criminal record, as well as proof of
the tenant's liability insurance, the latter having to be
maintained throughout the term of the lease. Each co-owner
is strictly obliged to ensure, by virtue of the portrait
received, that the tenant chosen will respect the
declaration of co-ownership, its by-laws, as well as the
rules of community living in respect of his neighbourhood.
A co-owner who has not obtained such a portrait before
choosing his tenant is at fault and liable for all damages
and penalties resulting from the fault or act of the tenant
or a member of his family, including claims within the
meaning of articles 1074.1 et seq. C.c.Q.

The co-owner is also required to obtain the said portrait
before any transfer of lease, assignment and/or sublease.
